A senior lawyer of India's Supreme Court Ram Jethmalani has claimed to have met Dawood Ibrahim in London, where the fugitive underworld don offered to surrender himself and his close associate Chota Shakeel before Indian authorities.

In an interview to the ANI news agency published on Zee News channel's website, the senior lawyer said the proposal was rejected by the Sharad Pawar-led Maharashtra state government. He added that it was not the chief minister's decision alone, but the United Progressive Alliance (UPA) government was also a part of it.

Giving details of his meeting with Dawood Ibrahim, Jethmalani said that the underworld don had denied involvement in the 1993 Mumbai serial blasts and wanted assurance from Indian authorities that upon his return he will not be subjected to third-degree torture by the police while in detention.

The former law minister also said that the underworld don was ready to return to India and be placed under house arrest during the trial, as he feared he would be assassinated in jail.

In a Press Trust on Indian interview published on the NDTV website, Saharad Pawar, who was the chief minister of Maharashtra state in 1990s when the offer was made, said that, "It is true that Ram Jethmalani had given a proposal about Dawood's willingness to return. But there was a condition that Dawood should not be kept in jail. Rather he should be allowed to remain in a house. This was not acceptable. We said he had to face the law."

India has routinely accused Pakistan of providing shelter to one of India’s most wanted fugitive.

Pakistan denies Indian charges that it shelters Dawood Ibrahim — one of India's most wanted men — ever since the don became a fugitive for his alleged role in the serial bomb blasts that hit Mumbai in 1993 in apparent retaliation for the demolition of the Babri Masjid in December 1992. Over 250 people were killed in the attacks.

Ibrahim stands convicted in absentia in India for the blasts, together with several Mumbai accomplices.

In a reply submitted to the Indian Parliament recently in May, India's Home Ministry had said that the government had no clue about the whereabouts of underworld don Dawood Ibrahim.

Pakistan’s High Commissioner in India Abdul Basit had termed the admission as vindication of Pakistan's stance over the issue.

A few days later Indian Home Minister Rajnath Singh had said in the Lok Sabha that India had evidence of Dawood Ibrahim’s presence in Pakistan, and would bring him back “no matter what”.

Speaking in India Today's Seedhi Baat, (former home secretary and BJP MP RK) Singh stirred a hornet's nest when he revealed, "An operation to eliminate Dawood Ibrahim was being planned, before it was blown by actions of some Mumbai cops. Ajit Doval was involved in the operation."

The plot goes back to 2005. Current National Security Advisor Ajit Doval had retired as director of the Intelligence Bureau in January that year. News broke that Dawood's daughter Mahrukh was to marry Pakistani cricketer Javed Miandad's son Junaid.
The Nikah was to be performed at Mecca on 9 July while the Walimah (reception) was fixed for 23 July at the Grand Hyatt in Dubai. As soon as Indian intelligence agencies got wind of Dawood's plan, a plan was hatched to eliminate the don in Dubai. IB officials felt that this was their best chance to eliminate him, as it was very rarely that they had specific information about where India's most wanted man was going to be. By the middle of 2000, international pressure had begun to mount against Pakistan to act against Dawood Ibrahim who had been designated by the United Nations as a globally wanted terrorist. It had become difficult for Dawood to move in and out of Pakistan easily. But there was no way he was going to skip the reception.

The government wanted full deniability in case the plan went kaput and so a decision was taken to engage members of the Chota Rajan gang instead of sending commandos. Doval was made in charge.
Chota Rajan had split with Dawood after the Bombay blasts of 1993 and was looking for a chance to avenge the attack on him in Bangkok in 2000 for which he deputed two of his trusted men Vicky Malhotra and Farid Tanasha.
According to Singh, the men were trained at a secret location in India and a plan to eliminate Dawood was finalised. Tanasha and Malhotra were given fake travel documents and tickets to reach Dubai.
But that's when things started to go wrong. Unknown to the Intelligence Bureau officials, cops in the Mumbai police got to know about the presence of members of the Chota Rajan gang in India. Singh alleges that Mumbai police officers deliberately sabotaged Operation Dawood because of their close ties with the gangster.
However, according to media reports of the time, Deputy Commissioner of Police in the Mumbai Crime Branch Dhananjay Kamlakar was despatched to Delhi by his seniors with the explicit instruction to arrest the members of the Chota Rajan gang. Kamlakar later said he was told that the Rajan gang members had entered India to eliminate a politician or top businessman.
The IB's plan was ready. One afternoon when Doval was doing a final briefing of the Rajan gang members, Kamlakar's team dashed into the hotel. At that time the three of them were reportedly poring over the blueprint of the Grand Hyatt hotel to determine the best position to install the sharpshooters.
Doval reportedly lost his cool and tried to explain to the cops who he was but Kamlakar arrested Tanasha and Malhotra and took them to Mumbai.
Doval was forced to back off. One of the most audacious operations to eliminate the underworld don unravelled because of an ugly turf war between India's security agencies. The next morning the incident was widely reported in the major national dailies.
Later when asked Doval for his reaction, the super sleuth denied all knowledge and said that he had been watching TV at home at that time. Singh says that India should not be disheartened because one operation did not materialise.

Levy recently co-authored Spy Stories: Inside the Secret World of the RAW and the ISI, published by Juggernaut, with author-journalist Cathy Scott-Clark.

In the book, you describe Kulbhushan Jadhav as an asset and not an officer. What is the difference?

In Jadhav, Pakistan spotted an opportunity. India required a new facility post 26/11; there was a need to step up and deploy assets that had access deep inside Pakistan and neighbouring countries to illuminate operations by Jaish, LeT and Al Qaeda. Given that actions by these groups had been switched down to only a simmer in Kashmir, they re-formed in Karachi and elsewhere looking for new routes to attack India. All agencies in India needed to reset around this thesis, be it the Indian Navy, the Intelligence Bureau or R&AW.



India worked hard to make connections through assets in Tehreek-e-Taliban Pakistan and [among] Baloch nationalists, as well as seeking influence in places like Iran’s Chabahar Port, which was the natural competitor to Gwadar Port. So, there is China and Pakistan in Gwadar and R&AW and Iran in Chabahar. What we have are two ports of extreme strategic importance in Central Asia. And then there is Kulbhushan Jadhav working in Chabahar, but also able to traverse Pakistan and India. The man has at least two forms of official identity, mis-describing his religion and an actual address in Mumbai that the ISI learns is linked to a former senior police officer. The ISI sees a perfect opportunity to trap India. To build Jadhav from a roving itinerant—a roving ear—into being seen as an Indian master spy.

Are you saying Pakistan’s claim on Jadhav is real?

What cops do is detect crimes and put them through the criminal justice system, but what spymasters do is latch on to a crime and let it run as long as possible to see what the man is up to. They germinated an idea—in this case a conspiracy to attack a Pakistan air force base—and thrust upon him plans for the base, making him a party in a serious criminal conspiracy. They waited to see whom he would contact. Would he find a Baloch national? All along, in the background, they know he is a family man with kids. So, Jadhav gets jammed between spy wars of two sides.

In spy wars, enemy's enemy is your friend. How true is it for India?

Agencies like R&AW and Intelligence Bureau are using forces and assets and officers of every kind against Pakistan. This is classic intelligence work and this is what R&AW should be doing and is doing, while shielding its actions. It did that with MQM, when it was divided and its leader took asylum in London - recruiting inside MQM. The agency does this in London, Vienna, Geneva and other safe European havens and not within the theatre which is Pakistan. It does this with other outfits in Kashmir and along the Durand Line.
